Welcome to Kadsyscon Infotech. These Terms of Service ("Terms") govern your access to and use of our software development, consultancy, web platforms, mobile applications, cloud solutions, and IT infrastructure services. By using our website or signing a service agreement, you agree to comply with and be bound by these Terms.
1. Services Provided
Kadsyscon Infotech delivers engineering, technical consulting, and digital solutions. Project parameters, delivery milestones, and payment schedules are governed by individual Statements of Work (SOWs) or agreements signed between Kadsyscon Infotech and the client.
2. Intellectual Property Rights
Unless explicitly agreed in writing within a Statement of Work:
- All pre-existing materials, boilerplate code, libraries, and tools owned by Kadsyscon Infotech remain the exclusive property of Kadsyscon Infotech.
- IP ownership of custom deliverables transfers to the client upon receipt of complete and final payment for the respective milestones.
3. Fees, Payments & Subscriptions
Clients agree to pay Kadsyscon Infotech according to the billing schedules defined in their agreements. Invoices are due within 14 days of receipt. Late payments may result in the suspension of active development cycles, cloud hosting services, or support SLA packages.
4. Limitation of Liability
Kadsyscon Infotech is not liable for indirect, incidental, special, or consequential damages (including loss of profits, revenue, or database corruption) arising out of or related to the deployment of software solutions, server downtime, or third-party service provider failures.
5. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Maharashtra, India, without giving effect to principles of conflicts of law. Any legal actions or disputes must be settled exclusively in the competent courts of Kalyan/Mumbai, India.
